Bicycle, Boat, or Plane DUI

California's Vehicle Code states that driving under the influence of drugs or alcohol while operating any vehicle is illegal and provides strict punishments for DUI.  Since California state law defines "vehicle" as any conveyance that operates under non-human power, this is even applicable to bicycle, boat, or plane DUI and DUI involving tractors or bulldozers.  Mopeds, scooters, and motorcycles are also considered vehicles under DUI laws.

The procedures and penalties for your San Diego bicycle, boat, or plane DUI will depend on the circumstances of your arrest.  If you are pulled over on a motorcycle or scooter in San Diego, your case will be considered a motor vehicle DUI and prosecuted both through the DMV and the court system.  If you are arrested while driving a boat in San Diego, your case will be subject to the courts and the California Harbors and Navigation Code.  This code carries a different standard of "under the influence" for commercial (0.04% BAC) and non-commercial (0.08%) boats than that of the DMV.  Flights under the influence are prosecuted in criminal court and through the Federal Aviation Administration and can have far more severe punishments than a typical DUI.  Lastly, bicycle DUI  in San Diego is generally considered a less severe crime and is usually punished with a warning and a fine.

If you are convicted of a San Diego DUI while on the job, your commercial driving privileges or boating or flight license could be suspended or even revoked, causing a loss of crucial income.  However, the circumstances of your San Diego DUI will influence your charge and your punishment.  For example, issues of private roadways or waterways are explored in greater depth with bicycle, boat, or plane DUI cases than in standard DUIs.

Like standard San Diego DUIs, the punishments for bicycle, boat, or plane DUI can be severe.  You could lose your license or be required to serve time in jail.  Luckily, you have the right to representation by an attorney in court, even if you are accused of DUI in San Diego while driving a motorcycle, plane, or boat.  Take advantage of the opportunity to seek an attorney with the reputation and experience it takes to get the defense you deserve, an attorney like Stephen Brodsky, whose San Diego DUI defense practice has been in effect for over 20 years.  Have you been accused of DUI for a boat, plane, or motorcycle?  Don't delay.  Contact Stephen Brodsky today for more information and a free case consultation.
